PRIVACY POLICY CONSENT TO THE COLLECTION OF PERSONAL DATA
Personal data will be used only in conformity with the Italian and UE law (art. 13, D.Lgs. 30 giugno 2003 n. 196 and Regulation (EU) 2016/679 of the European Parliament and of the Council).
Balassa S.r.l., with registered office in Via Manzoni, 17 – 23827 Lierna (LC), CF and P.IVA 03015300134 (hereinafter, “Data Controller”), as data controller, informs you pursuant to art. 13 Legislative Decree 30.6.2003 n. 196 (hereinafter, “Privacy Code”) and art. 13 EU Regulation no. 2016/679 (hereinafter, “GDPR”) that your data will be processed in the following manner and for the following purposes:
1. Subject matter of treatment
The Owner will process the personal and identification data (hereinafter “personal data” or “data”) you have provided for the services of the Owner for himself and/or as head of the family or group leader of your arrival today at the accommodation in Perledo Strada del verde, 8.
2. Purpose of treatment
Your personal data are processed for the following purposes:
Fulfilment of the obligation to communicate the personal details of guests of tourist facilities imposed by the T.U.L.P.S. Royal Decree No 773 of 18 June 1931, as amended and supplemented .
Fulfilment of contractual and tax obligations arising from relations with you;
Organizational and productive needs;
Fulfilment of the obligations provided for by law, regulations, Community legislation or an order of the Authority (such as, for example, anti-money laundering);
Exercise of the rights of the Holder, for example the right of defence in court.
3. Place
Your personal data are processed and stored at the registered office: Via Manzoni, 17 – 23827 Lierna (LC).
4. Treatment modalities
The processing of your personal data is carried out by means of the operations indicated in art. 4 Privacy Code and art. 4 No 2) GDPR, namely: collection, recording, organisation, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, processing, modification, selection, extraction, comparison or interconnection, blocking, limiting, erasure and destruction of data.
Your personal data are subject to both paper and electronic processing.
The Data Controller will process personal data for the time necessary to fulfil the purposes mentioned above and in any case for no more than 10 years from the termination of the relationship for the Purposes of Service.
With regard to the purpose of fulfilling the obligation to communicate the personal details of guests (T.U.L.P.S. Regio Decreto 18 giugno 1931 n° 773 e s.m.i.), the photocopies of the identification documents are destroyed by Balassa S.r.l. once sent to the Questura di Lecco and in any case within 48 hours from the day of arrival.
5. Access to data
Your data may be made accessible for the purposes referred to in point 2:
to employees and collaborators of the Owner;
to those entitled to fulfil their obligations under the law.
6. Reporting
Without the need for express consent (art. 24 letter a), b), d) Privacy Code and art. 6 letter b) and c) GDPR), the Owner may communicate your data for the purposes set out in art. 2.A) to Supervisory Bodies, Judicial Authorities, insurance companies for the provision of insurance services, as well as to those persons to whom communication is compulsory by law for the fulfilment of said purposes. These entities will process the data in their capacity as autonomous data controllers.
Your data will not be disclosed.
7. Nature of the data provision and consequences of refusal to respond
The provision of data for the purposes referred to in art. 2. is mandatory. Without them, we cannot guarantee you the services of art. 2..
8. Rights of the data subject
As the data subject, you have the rights under Article. 7 Privacy Code and Art. 15 GDPR and precisely the rights of:
i. to obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet recorded, and their communication in intelligible form;
ii. obtain the indication of: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied in case of processing with the aid of electronic instruments; d) the identification details of the owner, managers and representative appointed pursuant to art. 5, paragraph 2 of the Privacy Code and art. 3, paragraph 1 of the GDPR; e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representative in the State’s territory, managers or agents;
iii. obtain: a) the updating, rectification or, when interested, integration of the data; b) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is not necessary in relation to the purposes for which the data was collected
9. Conditions for the exercise of rights
You may exercise your rights by sending at any time:
